Terms and Conditions for the Sale of Goods

§ 1. General

These Terms and Conditions ("T&Cs") govern the sale of goods by HOUSE OF MEMORIES ("the Seller"), located at Hong Kong, and apply to all orders placed by the buyer ("the Buyer"). By placing an order, the Buyer agrees to these T&Cs.

§ 2. Products

The goods supplied are products of daily necessity as described in the Seller's catalog or product listings. The Seller reserves the right to modify the product specifications without prior notice to ensure continuous improvement.

§ 3. Prices

All prices are quoted in USD and are exclusive of taxes, duties, or other levies, unless otherwise specified. Any applicable taxes or customs duties are the sole responsibility of the Buyer.

§ 4. Payment Terms

Unless otherwise agreed, payment terms are as follows:

Payments must be made immediately.

The Seller reserves the right to charge interest at 3% per annum on overdue invoices.

§ 5. Delivery and Shipping

Goods will be shipped Incoterms DDP - Delivered Duty Paid - Hong Kong, unless otherwise agreed in writing.

Delivery dates provided by the Seller are estimates. The Seller shall not be held liable for delays caused by factors beyond its control, including but not limited to transportation issues, customs clearance, or natural disasters.

Risk of loss or damage to the goods shall pass to the Buyer upon delivery to the shipping carrier.

§ 6. Title of Goods

Title to the goods shall pass to the Buyer once full payment has been received by the Seller. Until payment is made in full, the Seller retains ownership of the goods.

§ 7. Inspection and Acceptance

The Buyer is required to inspect the goods upon delivery and notify the Seller of any discrepancies or defects within 3 days.

Failure to notify the Seller within this period constitutes acceptance of the goods.

§ 8. Warranty

The Seller warrants that the goods conform to the specifications provided at the time of sale.

In case of defects in the goods, the Seller’s liability is limited to replacement or repair of the defective goods or a refund of the purchase price, at the Seller's discretion. No other warranties, express or implied, are provided.

§ 9. Limitation of Liability

The Seller’s liability, whether in contract, tort, or otherwise, is limited to the total amount of the purchase price paid by the Buyer for the goods in question.

The Seller shall not be liable for any indirect, incidental, or consequential damages.

§ 10. Force Majeure

The Seller shall not be held responsible for any delay or failure in performance of any part of this agreement due to causes beyond its control, including but not limited to acts of God, war, labor strikes, transportation delays, or governmental regulations.

§ 11. Governing Law and Jurisdiction

These T&Cs shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising under or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

§ 12. Termination

The Seller reserves the right to terminate any order if the Buyer fails to comply with these T&Cs or if the Buyer becomes insolvent or bankrupt.

§ 13. Amendments

The Seller reserves the right to amend these T&Cs at any time. Any amendments will take effect on orders placed after the amendment has been published.

§ 14. Entire Agreement

These T&Cs, along with any purchase orders and invoices, constitute the entire agreement between the Seller and the Buyer and supersede all prior agreements, written or oral.

Return and Refund Policy

At HOUSE OF MEMORIES, we are committed to ensuring your satisfaction with our products. If, for any reason, you are not satisfied with your purchase, our Return and Refund Policy provides you with the necessary steps to address any issues.

§ 1. Returns

Eligibility for Returns: You may return items purchased from HOUSE OF MEMORIES within 14 days of delivery for a refund or replacement, provided that:

The goods are unused, undamaged, and in their original packaging.
You have obtained prior authorization from our customer service team for the return.

Non-Returnable Items: The following items are not eligible for return:

Perishable goods.
Goods that have been customized or specially ordered at the Buyer’s request.
Goods that are marked as “final sale” or “non-returnable” at the time of purchase.

§ 2. Return Process

Requesting a Return:

To initiate a return, please contact our customer service at info@houseofmemories.life within 14 days of receiving your goods. You will be provided with a Return Merchandise Authorization (RMA) number, which must be included in your return shipment.

Return Shipping:

The Buyer is responsible for all return shipping costs, except in cases where the goods were received damaged or incorrect due to an error by HOUSE OF MEMORIES. We recommend using a trackable shipping service, as we cannot guarantee receipt of returned items without proof of delivery.

§ 3. Refunds

Eligibility for Refunds:

Refunds will only be issued for goods that meet our return eligibility criteria and have been inspected and approved by our team.

Refund Method:

Refunds will be processed within 14 business days after the returned goods are received and inspected. The refund will be issued to the original method of payment unless otherwise agreed.

Partial Refunds:

In some cases, partial refunds may be granted, such as:

Goods returned after the 14-day return window but within a reasonable time frame.

Items that are not in their original condition or are missing parts, not due to an error by HOUSE OF MEMORIES.

§ 4. Damaged or Defective Goods

Inspection on Delivery:

We advise all customers to inspect goods upon receipt and notify us of any damages or defects within 3 days. If the goods were damaged during shipping or are found to be defective, we will replace the goods or issue a full refund, including shipping costs.

Reporting a Claim:

Please contact us at info@houseofmemories.life with photos and a description of the damage or defect. We will guide you through the next steps, including shipping instructions for the return, if necessary.

§ 5. Exchange Policy

We only replace items if they are defective or damaged. If you need to exchange an item for the same product, please contact our customer service team to arrange an exchange.

§ 6. Non-Refundable Items

The following items are not eligible for refunds:

Shipping costs (except in cases of defective or incorrect goods).
Customs duties and taxes paid on international orders.
Items purchased during a promotional or sale period, unless otherwise stated.
